Web Site Terms and Conditions of Use

1. Terms

By accessing this web site, you are agreeing to be bound by these
web site Terms and Conditions of Use, all applicable laws and regulations,
and agree that you are responsible for compliance with any applicable local
laws. If you do not agree with any of these terms, you are prohibited from
using or accessing this site. The materials contained in this web site are
protected by applicable copyright and trade mark law.

Training Courses: Any training course purchased through this website will be subject to either the terms issued by the course providers or the terms issued by  Dita Health & Social Care Consultancy Ltd in its capacity as reseller of the training courses. The appropriate terms will be issued at time of purchase.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials
    (information or software) on Dita Health & Social Care Limited’s web site for personal,
    non-commercial transitory viewing only. This is the grant of a license,
    not a transfer of title, and under this license you may not:

    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Dita Health & Social Care Limited’s web site;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or “mirror” the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Dita Health & Social Care Limited at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Purchase, Cancellation & Refund

3.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Consumer Contracts Regulations”) you may cancel your purchase of the Course within a period of 14 calendar days (“Cancellation Period”) from the date on which the contract is concluded subject to Clauses 3.8 and 3.9.

3.2 You must inform Dita Health & Social Care Consultancy Ltd of your decision to cancel by using one of the following methods within the Cancellation Period:

3.2.1 Emailing admin@ditaconsulting.co.uk;

3.2.2 Calling for  advice on 01375 856953; or

3.3 If you cancel your purchase you must return any Study Materials you may have received from Dita Health & Social Care Consultancy Ltd without undue delay and not later than 14 calendar days after you inform Dita Health & Social Care Consultancy Ltd of the cancellation to, Dita Health & Social Care Consultancy Ltd, Office 3, Tilbury Riverside Arts Activity Centre, Ferry Road, Tilbury, ESSEX, RM18 7NJ,  in a reasonable and resaleable condition (for audio, video or software products this means in the sealed package in which they were delivered).You will be liable for the cost of returning any goods to Dita Health & Social Care Consultancy Ltd unless Dita Health & Social Care Consultancy Ltd has agreed otherwise in writing.

3.4. Dita Health & Social Care Consultancy Ltd reserves the right to withhold payment of part or all of your Fee refund until all Study Materials have been returned in accordance with Clause 4.3 above or if Study Materials are not returned in a re-saleable condition.

3.5 On cancellation you will be entitled to a full refund of the Fees and the Outbound Delivery Costs subject to the following limitations:

3.5.1 In relation to Outbound Delivery Costs, the refund amount will be capped at the cost of a standard postal method fee; and

3.5.2 If the value of the goods has been diminished by your handling, Dita Health & Social Care Consultancy Ltd may recover the amount of this diminished value by deducting this amount from your refund.

3.6 If you cancel a Course after the Cancellation Period, Dita Health & Social Care Consultancy Ltd will deduct from any refund of your Fee the cost of all applicable delivery charges, including Outbound Delivery Costs.

3.7 Refunds will be made using the same method of payment as you used for the purchase and will be paid within 14 days of you informing Dita Health & Social Care Consultancy Ltd of the cancellation. The period for refund will increase to 30 days if Dita Health & Social Care Consultancy Ltd is unable to credit a UK bank account. If you have chosen to invoice your employer and at the time of cancellation the relevant invoice has not yet been paid then such invoice will be cancelled. If you have chosen to invoice your employer and at the time of cancellation the relevant invoice has already been paid by your employer, the Fees will be credited to your employer’s bank account within 14 days of cancellation (provided a UK bank account can be credited). For monetary returns a request in writing to admin@ditaconsulting.co.uk  is required from your employer.

3.8 Your right to cancel and obtain any refund will be lost if you have given Dita Health & Social Care Consultancy Ltd express consent to supply any services during the Cancellation Period and the service has been fully performed. If express consent has been given but the service is only part performed, you will be liable to pay for the services actually received.

3.9 If the contract is for the supply of digital content including but not limited to eBooks, Online Course and Online Study Materials your right to cancel and obtain any refund will be lost if you have given Dita Health & Social Care Consultancy Ltd express consent to supply the digital content to you during the Cancellation Period or if you access the digital content before the expiry of the Cancellation Period.

3.10 For further details of your rights under the Consumer Contracts Regulations you can visit your local Citizens’ Advice Bureau or visit the Competition and Markets Authority website.

3.11. Your order of a Course is personal to you and you will not be permitted to transfer your enrollment on a Course to any other student.

3.12 Dita Health & Social Care Consultancy Ltd reserves the right to use its discretion to determine whether to make refunds and/or deferrals in exceptional circumstances which fall outside Clause 4 and Clause 5 and to charge additional fees in any such event.

3.13. If Study Materials accompany your Classroom Course and these have been dispatched to you prior to you deferring your place on the Classroom Course, Dita Health & Social Care Consultancy Ltd will be under no obligation to provide you with any revised or updated Study Materials relating to your deferred Classroom Course and any additional Study Materials required by you will need to be purchased by you prior to commencing you deferred Classroom Course.

3.14. Where you have purchased multiple Classroom Courses as part of  Dita Health & Social Care Consultancy Ltd package of products and you cancel or defer one or more of those Classroom Courses, each Classroom Course which you cancel or defer will be treated separately and the relevant cancellation and deferral terms and administration costs set out in this Clause 5 will apply to each cancellation or deferral.

4. Disclaimer

  1. The materials on Dita Health & Social Care Limited’s web site are provided “as is”. Dita Health & Social Care Limited makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Dita Health & Social Care Limited does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

5. Limitations

In no event shall Dita Health & Social Care Limited or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Dita Health & Social Care Limited’s Internet site, even if Dita Health & Social Care Limited or a Dita Health & Social Care Limited authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

6. Revisions and Errata

The materials appearing on Dita Health & Social Care Limited’s web site could include technical, typographical, or photographic errors. Dita Health & Social Care Limited does not warrant that any of the materials on its web site are accurate, complete, or current. Dita Health & Social Care Limited may make changes to the materials contained on its web site at any time without notice.
